Enforcement Notices Quashed and Varied in Respect of Ancillary Residential Buildings.
DLP Planning Ltd (Bristol) has successfully appealed against a series of enforcement notices which alleged a change of use of agricultural land to residential use and sought the demolition of a games room, tennis court, changing room, gym, hobby room, store and garages at house in the Bristol Green Belt. The decision follows a two-day public inquiry held in November. There was never any dispute that the works constituted inappropriate development in the Green Belt. However, DLP Planning Ltd was able to persuade the Planning Inspector that, as a matter of fact and degree, and having regard to a detailed analysis of the planning history of the site stretching back over 25 years, that the land was in residential use and comprised part of the curtilage of the house. The buildings, with one exception which exceeded 4 metres in height, were consequently permitted development.
