Appeal allowed for conversion of former industrial building

DLP (Planning) Ltd has overturned the decision of Erewash Borough Council to refuse planning permission for the conversion of a former industrial building in Ilkeston, Derbyshire into 14 residential units.

DLP Ltd successfully appealed the decision demonstrating that the development would not significantly harm living conditions of the occupants of neighbouring residential properties with regard to privacy and would not have any significant harm to highway safety as alleged by the Council. The appeal further demonstrated that the proposals were in accordance with the relevant policies of the Development Plan and represented a sustainable form of development.

DLP also successfully applied for a full award of costs. The Inspector agreed with the case submitted that the Council had acted unreasonably having failed to produce evidence to substantiate their reasons for refusal.

Subject to conditions, the Planning Inspector was satisfied that the proposed development was acceptable and as such allowed the appeal.
